Nature of Practice

Alan Mirman is a founding partner in the law firm of Mirman, Bubman & Nahmias LLP, in Woodland Hills, California. For more than thirty years, Mr. Mirman has specialized in creditor's rights, real property law, business litigation, commercial and financial institutions litigation and documentation. He is a 1975 graduate of the UCLA School of Law, where he was the Chief Justice of the Moot Court Honors Program. Mr. Mirman has attained Martindale-Hubbell Law Directory's highest rating of "AV". Mr. Mirman has also received the designation by Law & Politics as a Southern California "Superlawyer" for the years 2007 through the present. His emphasis has been on the following types of matters:

  • Litigation
    State Court and Federal Court litigation relating to issues such as real property secured transactions, lien and title disputes, commercial transactions, and negotiable instruments. Representation of Receivers in litigated matters. Pre-judgment remedies, including Writ of Attachment, Writ of Possession, Receivership, and injunctive relief.
  • Real Estate
    Purchase and sale negotiation and documentation; Lease negotiation and documentation, both for landlords and tenants; resolution of real property lien, priority, or management disputes.
  • Documentation
    Loan documentation, structuring of transactions, perfection of security interests; workouts and problem loans. Operations advice.
  • Bankruptcy
    Representation of creditors in Plan and Claim litigation or contests, relief from stay, and non-dischargeability.
  • Expert Witness
    Retained as an expert witness in numerous cases relating to financial disputes, including provisional and post-judgment remedies (such as Writ of Attachment, Writ of Possession, and levies), real estate issues, negotiable instruments, fraudulent transfers, and lending issues.

  • 1983-86,1987-90: Debtor/Creditor and Bankruptcy Committee of the Business Law Section of the State Bar, with emphasis on analyzing and proposing changes in the law concerning pre-judgment remedies, mixed collateral, the one action rule, and fraudulent conveyances
  • 1987 - present: Executive Committee of the Los Angeles County Bar Association Provisional and Post Judgment Remedies Section. 1992-93, Chair of Executive Committee; 1987-96, Editor of Section Newsletter

  • 1993 - 1995: Ad Hoc Committee on Receiverships, appointed by Presiding Judge of Los Angeles Superior Court. This Committee revised local rules relating to Receiverships, and consulted with the Court pertaining to procedures applicable to Receiverships.
  • 2003 - present: Commercial Law Committee of the Los Angeles County Bar Association Commercial Law and Bankruptcy Section

Legislation

Represented the State Bar Business Law Section’s Debtor/Creditor and Bankruptcy Committee in successfully advancing new legislation in 1990 to revise a portion of the Writ of Attachment statute concerning eligibility of under-secured creditors holding personal property collateral. Worked with the Senator sponsoring the legislation, the State Bar lobbyist, and particularly with the legislative analyst for the Chairman of the Senate Judiciary Committee to overcome objections to the Bill. Testified before the Senate Judiciary Committee, and coordinated with the California Law Revision Commission regarding implementation of the 1990 Amendments. In 1995, coordinated with the California Law Revision Commission and State Bar lobbyist to extend the "sunset" provision of the 1990 Amendments, which otherwise would have resulted in the January 1, 1996 elimination of the revisions effected by the 1990 Amendments. In 1997, coordinated with the Commission in support of successful legislation making the Amendments permanent.
