Creditors' Rights

We maximize results through careful and cost-effective use of pre-judgment remedies to expediently recover funds through litigation. Our firm goal is to preserve and protect your rights, whether enforcing liens or other rights in security pre-trial, by recovering assets post-trial, or by taking action necessary to avoid trial if appropriate. We investigate available debtor assets and understand the issues relating to priorities in recovering those assets. We carefully review each case to determine how to best recover on behalf of our clients, including creating or preserving rights to maximize recovery from both tangible and intangible assets, intellectual property rights, and other atypical assets or interests.

When appropriate, we recommend the use of receivers to enforce rights to property and preserve assets for trial or by seeking resolution through summary judgment. Alan Mirman is a founding Board member of the California Receivers Forum. He frequently lectures on receiverships and related remedies, and he often applies his experience to creditors’ rights cases we handle for clients. Michael Bubman has been called upon to provide guidance to health care regulators on receivership issues and regularly represents receivers in health care settings, including long term care facilities, senior housing arrangements and a variety of other health delivery systems.
