Financial Institutions Representation

Contact: Alan Mirman or Alan Nahmias

Financial documents, instruments and transactions change as rapidly as the financial landscape, and legislation including recent statutes relating to foreclosure laws cause financial institutions to quickly adapt to current demands and rules.

Assisting in the resolution of problem loan situations requires an understanding of the needs of the institution and the type of credits involved, whether a traditional loan customer, an SBA loan or a credit that has been classified as a “special asset.” We work with the bank officers responsible for recovery of the obligation to accomplish the best result for the institution, whether through forbearance, alternative dispute resolution or litigation. We are ready to take whatever action is necessary, including any pre-judgment remedies that may warranted.

We represent international, national and local financial institutions of all sizes, in litigation, documentation, and select areas of compliance work, including, but not limited to the following:

  • Litigation, including all pre- and post-judgment remedies required;
  • Documentation of loans;
  • UCC Article 9 matters, including granting, perfection and priority of security interests;
  • UCC Article 3 and 4 issues relating to checks and other instruments;
  • Responses to levies and garnishments;
  • Letter of credit issues;
  • Third party claims;
  • Inter-creditor agreements and disputes;
  • Responding to consumer complaints to regulators and regulatory agencies.
